These Terms of Service ("Terms") constitute a legally binding agreement between you and Elite Performance Institute San Diego ("Company," "we," "us," or "our"), a professional healthcare practice located at 444 West C St STE 190, San Diego, CA 92101.

By accessing our website at episandiego.com (the "Site") or using any of our services, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), have the legal capacity to enter into these Terms, and agree to be fully bound by them. If you do not agree to these Terms, you must immediately cease using the Site and our services.

Elite Performance Institute San Diego provides professional chiropractic care, sports medicine, physical rehabilitation, personal injury recovery services, and related healthcare services (collectively, "Clinical Services"). The Site is provided to facilitate appointment scheduling, provide general information about our services, and enable communication between prospective and existing patients.

The Site and its content are provided for informational purposes only. Nothing on the Site constitutes medical advice, a clinical recommendation, or a provider-patient relationship until you have completed an in-person intake process and an authorized clinician has formally initiated care.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate fully with our defense.

Informal Resolution: Before initiating any formal dispute resolution, you agree to contact us at EPI@SANDIEGO.COM to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days of receipt.

Jurisdiction: For any disputes not resolved informally, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in San Diego County, California. You waive any objection to the laying of venue in such courts.

Waiver of Class Action: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found unenforceable, the entire arbitration provision shall be null and void.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, HIPAA Notice of Privacy Practices, and Medical Disclaimer, constitute the entire agreement between you and Elite Performance Institute San Diego with respect to your use of the Site and supersede all prior and contemporaneous agreements, representations, and understandings of any kind between the parties relating to the subject matter herein.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
